Introduction: Modern Legal Philosophy
This article contributes to a growing understanding of the role of universal jurisprudence by providing a close examination of both its expository and censorial modes, with particular attention to their cosmopolitan qualities. Section one parses the concept of jurisprudence itself. Section two describes the censorial mode of universal jurisprudence, which lays down the principles for determining what should be law in all countries. Section three then analyses the principles of expository jurisprudence, which are used to define fundamental legal concepts. I there argue that the suite of expository tools are also useful for analysing the substance of law in any country, and that Bentham hoped such analysis would be the precursor to a global comparison and exchange of laws between all countries. Where Bentham has been acknowledged as part of the history of cosmopolitanism, it is largely as a moral cosmopolitan, or as a critic of natural rights.
This glorious title belongs to natural arrangement. If Hart were the archetype of legal positivism, and if neutral vocabulary or morally neutral description, as Hart believes, were the healthy centre of legal positivism, then Bentham is not a legal positivist. If Bentham, as conventionally interpreted, is the founder and prime exponent of the tradition of legal positivism, then this tradition cannot accept Hart and his contemporary followers. Cet article montre que la J. This paper has benefited tremendously from my countless conversations with Michael Quinn and Philip Schofield.
He advocated that if the consequences of an action are good, then the act is moral and if the consequences are bad, the act is immoral. Central to his argument was a belief that it is human nature to desire that which is pleasurable, and to avoid that which is painful. As a self-proclaimed atheist, he wanted to place morality on a firm, secular foundation. It is for them alone to point out what we ought to do, as well as to determine what we shall do. It is because of this emphasis on pleasure that his theory is known as hedonic utilitarianism.
Jeremy Bentham , born February 15, , London , England—died June 6, , London , English philosopher, economist, and theoretical jurist, the earliest and chief expounder of utilitarianism. Jeremy Bentham was a philosopher, economist, jurist, and legal reformer and the founder of modern utilitarianism , an ethical theory holding that actions are morally right if they tend to promote happiness or pleasure and morally wrong if they tend to promote unhappiness or pain among all those affected by them. Jeremy Bentham is important for being one of the founders of modern utilitarianism , a main current of philosophical ethics since the late 18th century, for his defense of psychological and ethical hedonism , and for his far-reaching proposals for the reform of Parliament , the legal code, the judiciary, and the prison system in Britain. The design features two circular towers, one inside the other, the outer one containing cells that face the inner tower from which guards, who would be invisible to prisoners, would have an unobstructed view of each cell. It is mainly associated with Positivism, the approach to law which concerns itself with positive law i. The major premise of analytical school of jurisprudence is to deal with law as it exist in the present form. It seeks to analyse the first principle of law as they actually exist in the given legal system. The exponent of analytical school of jurisprudence considered that the most important aspect of law is its relation to the State.
The Defence of Natural Law pp Cite as. The origins of the modern tradition in legal philosophy are generally associated with the emergence of the particular view of law and legal institutions adopted by jurists belonging to the school of legal positivism. The foundations of the positivist school of jurisprudence in the English-speaking legal world were laid by the great political scientist Jeremy Bentham — Bentham constructed a model of law usually referred to as the command or imperative theory of law. Bentham expounded this theory in great detail in writings which were not in fact published during his lifetime.
Is legal positivism tenable beyond moral relativism?
Jeremy Bentham was an English philosopher and political radical. He is primarily known today for his moral philosophy , especially his principle of utilitarianism, which evaluates actions based upon their consequences. The relevant consequences, in particular, are the overall happiness created for everyone affected by the action. Influenced by many enlightenment thinkers, especially empiricists such as John Locke and David Hume , Bentham developed an ethical theory grounded in a largely empiricist account of human nature.
