Environmental policy

Among the many purposes of environmental law, two stand out: the protection of personal and property rights and the preservation of places. Laws controlling pollution serve primarily the first goal; they constrain the risks people can impose on others. Statutes that pursue the second purpose seek to preserve national forests, landscapes, and landmarks; to protect historical districts; to maintain biodiversity; and to defend the integrity of ecological systems, such as rivers and wetlands. These two sorts of statutes emerge from two foundational traditions in the political culture of the United States , the first of which draws on the values of property and autonomy; the second, on those of community and diversity. The first tradition, which is associated with libertarianism and individualism, would protect each person from involuntary risks and harms.

Environmental policy , any measure by a government or corporation or other public or private organization regarding the effects of human activities on the environment , particularly those measures that are designed to prevent or reduce harmful effects of human activities on ecosystems. Environmental policies are needed because environmental values are usually not considered in organizational decision making. There are two main reasons for that omission. First, environmental effects are economic externalities. Polluters do not usually bear the consequences of their actions; the negative effects most often occur elsewhere or in the future.

Introduction to Environmental Law and Policy

Environmental law , principles, policies, directives, and regulations enacted and enforced by local, national, or international entities to regulate human treatment of the nonhuman world. During the late 20th century environmental law developed from a modest adjunct of the law of public health regulations into an almost universally recognized independent field protecting both human health and nonhuman nature. Throughout history national governments have passed occasional laws to protect human health from environmental contamination. In the 14th century England prohibited both the burning of coal in London and the disposal of waste into waterways. In the Quaker leader of the English colony of Pennsylvania, William Penn , ordered that one acre of forest be preserved for every five acres cleared for settlement, and in the following century Benjamin Franklin led various campaigns to curtail the dumping of waste. In the 19th century, in the midst of the Industrial Revolution , the British government passed regulations to reduce the deleterious effects of coal burning and chemical manufacture on public health and the environment. Prior to the 20th century there were few international environmental agreements.

State Environmental Policy Act (SEPA)

NEPA requires Federal agencies to assess the environmental effects of proposed major Federal actions prior to making decisions. Section of NEPA sets forth a national policy "to use all practicable means and measures, including financial and technical assistance, in a manner calculated to foster and promote the general welfare, to create and maintain conditions under which man and nature can exist in productive harmony, and fulfill the social, economic, and other requirements of present and future generations of Americans. NEPA ensures agencies consider the significant environmental consequences of their proposed actions and inform the public about their decision making.

Environmental law may be the one institution standing between us and planetary exhaustion. It is also an institution that needs to be reconciled with human liberty and economic aspirations. This course considers these issues and provides a tour though existing legal regimes governing pollution, water law, endangered species, toxic substances, environmental impact analyses, and environmental risk.
