In any State in which the Water Prevention and Control of Pollution Act, 6 of , is not in force, or that Act is in force but the State Government has not constituted a State Board for the Prevention and Control of Water Pollution under that Act, the State Government shall, with effect from such date as it may, by notification in the Official Gazette, appoint, constitute a State Board for the Prevention and Control of Air Pollution under such name as may be specified in the notification, to exercise the powers conferred on, and perform the functions assigned to, that Board under this Act.
A State Board constituted under this Act shall be nominated by the State govt. Every State Board constituted under this Act shall be a body corporate with the name specified by the State Government in the notification issued under sub-section 1 , having perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire and dispose of property and to contract, and may by the said name sue or be sued.

Of the 3 million premature deaths in the world that occur each year due to outdoor and indoor air pollution, the highest numbers are assessed to occur in India. According to the World Health Organization, the capital city New Delhi is one of the top most polluted cities in the world. Surveys indicate that in New Delhi the incidence of respiratory disease due to air pollution is about 12 times the national average. The act provides for the prevention, control and abatement of air pollution.

It is also a comprehensive legislation with more than fifty sections. It makes provisions, interalia, for Central and State Boards, power to declare pollution control areas, restrictions on certain industrial units, authority of the Boards to limit emission of air pollutants, power of entry, inspection, taking samples and analysis, penalties, offences by companies and Government and cognizance of offences etc.. The Act specifically empowers State Government to designate air pollution areas and to prescribe the type of fuel to be used in these designated areas.

India participated in the United Nations Conference on the Human Environment held in Stockholm in June to take appropriate steps for the preservation of the natural resources of the earth which, among other things, include the preservation of the quality of air and control of air pollution. Based on the concluding guidelines of this conference, the Air Act was formulated by the government of India in This is an Act to provide for the prevention and control and abatement of air pollution through various management guidelines and restrictions. One of the prime objectives of this act is carrying out the purposes mentioned above by assigning a set of responsibilities, powers, and functions to the Boards for the prevention and control of air pollution. The act was introduced and incorporated into the Constitution of India in laying down guidelines for the preservation of the quality of air and control of air pollution. There are a set of terms and conditions regarding the services of the members of the boards under the Water Act.
